By accessing or using this website, you agree to be bound by these Terms. If you do not agree, you must not use the website.
1. DEFINITIONS
“Company”, “we”, “us”, “our” means Infimood.
“Website” means www.infimood.com and all associated pages.
“Products” means any goods, including smart digital badges and accessories, offered for sale on the Website.
“Services” means the Website and any related services provided by the Company.
“Customer”, “you”, “your” means any person accessing the Website or purchasing Products.
2. ELIGIBILITY
You must be at least 18 years old or the age of majority in your jurisdiction to purchase Products. By placing an order, you represent that you meet this requirement.
3. ACCOUNT AND ORDER ACCEPTANCE
We reserve the right to:
• Refuse or cancel any order at our discretion.
• Limit quantities purchased per person or household.
• Cancel orders suspected of fraud or unauthorized resale.
An order confirmation email does not constitute final acceptance. A contract is formed only when Products are dispatched.
4. PRICING AND PAYMENT
All prices are displayed in the currency shown at checkout (default is USD).
We reserve the right to modify prices at any time without prior notice.
You agree to provide accurate billing and payment information. We may refuse or cancel transactions that appear fraudulent or unauthorized.
5. SHIPPING AND DELIVERY
Shipping timelines provided are estimates only.
Risk of loss and title to Products pass to you upon delivery to the shipping carrier.
The Company is not responsible for:
• Delays caused by carriers or global logistics.
• Customs clearance delays.
• Import duties, taxes, or local charges.
You are responsible for any applicable customs duties and import fees in your local jurisdiction.
6. RETURNS AND REFUNDS
Returns and refunds are governed by our separate Return & Refund Policy, which forms part of these Terms.
We reserve the right to refuse refunds where Products are:
• Used, scratched, or damaged by the user.
• Returned outside the permitted 30-day timeframe.
• Returned without original packaging or accessories.
7. PRODUCT DISCLAIMER (ELECTRONIC DEVICES)
Our Products are wearable smart electronic devices containing lithium batteries and LCD screens.
• They are not toys and should be kept away from infants and young children to prevent choking hazards from small parts (e.g., pins, charms).
• Customers are responsible for safe usage. Do not expose the Product to extreme heat, open flames, or prolonged water submersion.
• The Company is not liable for device malfunction caused by improper charging (e.g., using unauthorized high-voltage adapters) or physical damage (dropping, crushing).
• The Company is not responsible for the functionality or continuous availability of third-party companion apps (e.g., the Zrun app) used to control the badge.
8. INTELLECTUAL PROPERTY
All content on the Website, including but not limited to:
• Product designs and aesthetics
• Text, Photography, and Videos
• Logos and Trademarks including Infimood™
are owned by or licensed to the Company. No content may be copied, reproduced, distributed, or used without prior written consent. Unauthorized commercial use is strictly prohibited.
9. PROHIBITED USE
You agree not to:
• Use the Website for unlawful purposes or attempt to interfere with site security.
• Scrape or reproduce content.
• Engage in fraudulent chargebacks.
• Content Uploads: Use the Product to display, broadcast, or promote illegal content, hate speech, explicit imagery, or copyright-infringing materials via the companion app in public spaces. The Company holds no liability for user-generated content displayed on the Product.
10. THIRD-PARTY LINKS
The Website may contain links to third-party websites or direct you to third-party software (e.g., App Stores). We are not responsible for third-party content, app privacy practices, or software updates.
11. DISCLAIMER OF WARRANTIES
The Website and Products are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law: The Company shall not be liable for:
• Indirect or consequential loss.
• Loss of profits or loss of data.
• Personal injury or property damage resulting from misuse of the electronic Product.
Our total liability shall not exceed the amount paid by you for the Product giving rise to the claim.
13. INDEMNIFICATION
You agree to indemnify and hold harmless the Company from any claims arising from your misuse of the Website, the Products, or any violation of these Terms.
14. FORCE MAJEURE
We are not liable for failure to perform due to events beyond our reasonable control, including natural disasters, pandemics, government actions, or global supply chain disruptions.
